Seems like a pitty letter to me. Family matters have nothing to do with the fact his "buisness" is not producing "paid for" products for his customers. While this may not be considered fraud because of personal circumstances, it is definately something that legal action can resolve. I'd hate to see his lawyer fees if everyone ends up taking legal action.
