A young man in Maryland shot and killed an intruder who had broken into his house and shot the young man's mother, I believe she died on the scene. This is beleived to be a robbery incident. The young was arrested and they don't know what charges will be filed.
I know we were talking about this subject on another thread and thought I would let you guys know. I would have shot his ass, especially if my mother was hurt.
Uh, hell yeah I would have shot him! My only problem is that my 7.62x54r rounds would probably go through him, the wall, out the side of my house, thru my nieghbors house, thru their nieghbors house, etc...
I hope that kid doesn't get any grief for killing that piece of [shizzle]. He's already got enough to deal with, ya know, being as how his mother was murdered. Do you have a link for this article?
Actually it was just on the news a few mintues ago (breaking news). Seeing it reminded me of the other thread that is on the topic of hurting/killing someone if they break into your house and threaten you, your family or your property. I'll try to find a link.
Yeah, it's kinda lame how the law works. If someone breaks into your house, your first priority is to FLEE... not to defend your house and property.
In this case however, I think the guy was completely justified in shooting the intruder after the intruder shot his mom.
I actually agree that you should NOT be allowed to kill someone for breaking into your house... however if they are armed and especially if they have already shot someone then it's hunting season as far as I'm concerned.

I had to read that twice, because at first I thought it stated that he tried to kill an intruder, but killed his mother by mistake. If that was the case, he would probably be charged with Manslaughter. If all aspects of the shooting meet requirements for justified self defense, then he'll be alright. That still doesnt mean he'll go home the same he was prior to the shooting. Killing another human being whether its justified or not will change you forever. He was more than likely put in handcuffs, arrested, put in jail until his trial, the police department more than likely seized all of his guns, and theres a very good chance he'll never get them back. Hes probably facing civil charges and criminal charges in court, and even after he is found not guilty by reason of justified self defense, he will more than likely need counseling to help him cope with the psychological effects of ending another mans life.
But...theres a saying that ive read..."Its better to be judged by 12 than carried by 6". I hope everything works out for him

You CAN'T kill someone for breaking into your house, unless you catch them in the process. If you see someone halfway through your window trying to break into your house, then you have every right to shoot them. The family owns a local restaurant and the burglary could have been triggered for cash the burglar thought might be brought back home. Also the son was released later with no charges since it was self deffense. Hopefully that stays.
Yeah, it is ridiculous that they are even 'considering if and what charges will be filed!' I mean, come ON people!!

The generalized version of the common law is:

yes garrett, but in MA you cannot kill in defense of property, as i have posted the MGL on it b4 for you....and what jeff said (fastest95pgt) is true as well, for MA (he is from here too) you cannot kill if they are in your house if you can somehow flee. self defense doesnt matter in that case. and they will make SURE to find out if you could have fled....
