assaulted by cop. need advice.

ey.. im sure this happens all the time, at least ive heard of it happening to mates of mates of mine, but i dno wot i shud do.
heres wot happened.
i was speeding.. (yes yes i know, stupid ok i get it) saw an undercover drivin towards me in incoming lane, i cud tell they were gonna pull me over etc so as they were pulling a U turn behind me i went down a sidestreet n parked my car in an obscure driveway.. i was on the way to uni to hand in assignment, so i walked the rest of the way.. i took my jumper in which i was driving off (black n grey) n left it in the car. so i was wearing a white shirt. i saw the undercover cops circling the area, so i kept cool n walked along like nothing happened. i saw a normal cop car cruisin around also.
when i got back, i saw the undercover cop car parked behind my car so i was like ahh [fizzle].. oh well.. so i approached the cars n looked for the cops. i said hey i think u guys are looking for me, they said yep etc. it was all pretty much okay, calm voices n such. so then the cop walks up to my car n starts searching it, im like excuse me are u allowed to do that without my permission? im not really that comfortable with it. so he cracks the [shizzle]s, grabs me by the throat (leaving marks actually) n starts goin off.. n then lets go n says n if ur thinkin bout goin court u got no chance im a seniior sargeant etc no1 will believe u. so im like wtffff this guys a nutjob.. so he goes i know u were doin 120, i can impound ur car right now, how fast were u goin? and i (stupidly admitting) said oh i was goin 75, he goes nah u werent we both know it , how fast were u goin? i said ok i was goin like 82.. he said ok fine we'll leave it at that, u got lucky.. ull get the fine in the mail. n pisses off.
so i went to gfs house, n just in case i took photos of the marks.

now wot do u guys think? shud i go n file an assault report? or is it not worth it? one of my mates says that if i make a fuss they might dismiss the speeding fine? let me know ur feedback.
personally i think i got no chance.. but if im wrong let me know.

I would say make a fuss otherwise this asshole might keep doing it to other people it's just not on you might not get a reduction but the cop should have to be taught a lesson not to abuse his power.

I'd go straight into the police office right now (get a copy of the ticket just incase they do something at the station) and go complain right now it should have the cops name one it don't wait let them see the bruises themselfs

Go make a complaint, nothing will happen. Just put up with the speeding fine. I got done same thing, had cops pretty much stick there fingers in my ass, push me around and [shizzle]. No provacation from me I just didnt say anything the whole time. Went to go file a complaint at the police station about 15 mins later.

"I want to file a compaint, I was assualted by constable whatever"

"he goes yer thats fine whats the story"

I started explaining cuts me off in 2 secs, "it has to be in writing".

So then I say, " can I have a pen and paper" his response go home and get it yourself. I could see it was going nowhere so I said that they were all a bunch of [fizzle]ing tossers and just walked out. he didnt give a [shizzle].

Unless you got this on camera, you got nothing.

Altho u could install a camera for this type of stuff he had the car parked and stopped the system wouldnt be on so that wouldn't help

thnx 4 the advice guys, i think turk has it spot on. i got no chance, and ive heard people complaining about cops to cops n guess who harasses them on a consistent basis from then on? cops. i think yeh ill put up with the speeding fine.
2 questions tho:
1) are they allowed to search your car without your permission both if it is a random check or whether u actually did do something wrong?
2) how many points is it (and $$ amount?) for going 22km/h over?

not much justice will be given to the cop

ie senior sargent high up in the police force

no proof of phsyical assuault marks on your throat are nothing really no proof it was him etc

no one witnessed it no video proof

you can make the complaint but in reality not much will be done to the officer who assualted you

yer sounds about right.. ive been considering for a while to have a tape recorder in my car so ill have some sort of proof if anything ever happens.. even if it doesnt record video of them doin stuff i can just say "hey why did u hit me just then? etc" and obviously theyll say sum smart ass [shizzle] that incriminates them. meh i dno.. ive always disliked cops.. not much anyone can do about it.
always wanted to do army reserves tho, maybe that might give me some credibility in a court case (altho that is in no way the reason why im interested in doing reserves in the first place).

Maybe your attitude towards the cop was the problem

ie how did he start to go threw your car ? you would of locked it right?

Im always polite to police when pulled over etc etc its usually a 2 way street you give them respect and they will give you respect

Not saying you did anything otherwise to provoke him but some of your actions/attitude could of been contributed to why he did this to you.

By saying this im not sayings right for what he did to you, nor am i making excuses. Im just trying to get the point across maybe next time you can play it defensive and try to get away with this sorta stuff but the situation you are in now even if u do complain its very unlikely nothing will happen.

Chances are when he went to grab you by the throat you went to defend yourself maybe he we doing something else and your action *only natural* provoked his next actions upon you. Not saying what he did is right just explaining it like this so maybe if you or anyone else in such a situation can possible see something coming before its too late.

i know what ur trying to say.. im never an idiot around cops lol. i was completely and totally calm while talking to them, i was polite too. when he said can i see ur licence, i said yeh ill get it and i went to the car and opened it to get it from my glovebox, as soon as i ducked back out to give it to him he went in for a snoop around..
all i said was, in a very calm n nonthreatening way, "excuse me, are u allowed to search my car without my permission? because if not im not comfortable with it." and thats when he snapped.. jus got out n grabbed me by the throat n went off.. i didnt even try to defend myself, no point. but damn did i wana give him a nice swift kick to the nuts. asshole.
plus i wudnt have minded he was goin thru my [shizzle] if i didnt have a bus hammer (tiny red one) that was hidden behind a false headunit face, as well as a trolleypole under the passenger seat, half hidden by the carpet. funnily enough even after the assault when he went back to continue his search he didnt find either.

IF you have the name of the Officer, vehicle details and all that, it wont be too hard to make a report, but as mentioned without witnesses etc. its going to be hard.

A mate of my Brother, in Perth got pulled up and this is what happened:

- Mate gets pulled up doing NOTHING wrong, he had a mate in his car, so theres a witness

Cop: License and rego please
Mate: Yes Sir
Mate: What was i doing wrong Sir ?
Cop: Just give me license and rego !
Mate: Sits there for a minute and waits
Mate: With respect Sir i believe i have the right to know why you are pulling me over etc.
Cop: See this badge it means i can do what the F*** i want .... ( A bit more along these lines etc. )

My Mate took the vehicle number, rego, Officers Name and number and reported the lot, took him to court and the Officer lost out big time

Sometimes you will get them on a bad day and the best thing you can do is just say and do nothing until asked

so did the cop actually have a speed reading on your car? otherwise you shouldnt have admitted speeding, as he cant do anything without a reading , other than do you for reckless driving (which is worse i guess)

follow it up, if he has grabbed you file assault charges against the officer, because i believe the police department has to follow up all misuse of powers claims, if nothing is done take it to court.

report it... i didnt get far when i reported a cop hassling me the other day trying to make me speed. tail gating you name it he did it. best thing is to report it and when your in the cop shop kick up a fuss if your loud and annoying it will get everyones attention, they dont want everyone knowing about what happened. i got no where as i had no evidence of it.

mate its a shame there are wankers like that on the force......my fiancee has alot of family in the force, and they are top guys......then you get a big man with his badge that thinks he has the right to grab your throat? man i wouldnt stand for that, do something about it, they WILL look into it im telling you now.....its a good thing you got photos too.....

jmoore: nah the cop didnt get a reading he 'estimated', but he said that theyre trained to estimate with only 5km/h error, so in court they can say i did 120 n ill get done for 115 or summin.. n ive heard this a fair bit so i think that parts legit. still, im pretty sure they didnt get my plates, so had there been another mx6 around they wud have gotten done for sure. i didnt want to admit i sped but after the altercation i didnt want to get into an argument.
h3ff44: yer i dont have much evidence of it either, thing is he was with a lower ranking officer (a woman) and its gonna b two against one, coz ill bet she wont say anythin in court (or anywhere) to discredit him.
msf2: im thinkin once the fine actually comes, and itll have his name on it, ill go n report it (or is that too late?) coz thing im afraid of is that if he finds out ive gone n kicked a fuss about it, he might put a couple more charges in there (eg reckless driving etc).
